Accident claims
Accident claims take place everyday across the
United States. Thousands of people make an injury claim every year. The accident can happen at work, at home, on private or
public property or on the road. It can be a slip or a fall. Machinery could malfunction, turn
over or run over an individual. A dog or a child could bite you during a visit to a friend or your own bookcase could fall upon you. In these
instances, you could well file an accident claim.
Accident claims are compensation documents. The injured party files
one based on a hope the individual against whom the claim is being made will compensate for the injuries caused. The process can be a
simple or complicated one. It will involve, however, your insurance company, the opposing party, yourself, and, perhaps, police and
lawyers. If you decide to follow the accident claim route, you need to consider a number of things. This particularly pertains to
automobile accidents, but can be adapted to other accident claim situations.
How to claim after an accident?
Consider injuries. If they are severe, seek help from those nearby.
Try to find medical attention if necessary. At all points during the situation, co-operate with the police and the paramedics. Medical certificates are required to prove an injury. This will help you to establish the extent of your
injuries and provide collaborative evidence when you make a claim. The police can also help you gather or supply you with important
information. This will include the names and contact numbers of witnesses and participants. Do not neglect to get such vital information as
the other driver’s insurance information and their license data and a copy of the accident report. All will be essential factors in
supporting and proving your accident claim.
Whenever possible, compile photographic evidence of the extent of
both personal and property damage. Take pictures showing how severely your car or property is damaged. Today, many people have access to a
variety of high tech recording data. Cell phones, video cameras and other equipment are frequently on the scene. See if any person has
captured your accident on their phone or camcorder.
Keep in mind various state regulations regarding accident claims.
If an injury is involved, most states require you report the accident to the Department of Motor Vehicles in a specified amount of
time. You must also report it if the value of your car amounts to more than $500. As for
specific accident claims, these, too, are state dependent. Is your state a no-fault or comprehensive fault state? You need to know this. It
will indicate how difficult it will be to get a settlement. It is impossible to institute an accident claim against the other driver’s
insurance company if he or she does not have one.
In various circumstances, it may be necessary to hire a personal
injury attorney. This will help make the process flow a little smoother. It will be this person’s job to help you obtain money from your
insurance company, the other driver’s insurance company or both. A good and experienced attorney is especially beneficial if either
insurance company decides not to compensate you for your personal injury.
You cannot always avoid accidents. When they happen, try to be
prepared in advance with a plan of action, good insurance coverage and the name of an attorney.
