car accidents claimsAccidents occur every day, as do accident claims. Rules governing accident claims, however, vary from country to country. Whatever the type of accident and wherever the claim is made, insurance companies  and solicitors or lawyers are involved. In some instances, before you file an accident claim, you will need to consult a lawyer. This could be your personal lawyer or one who specializes in automobile accident claims. An attorney make focus on personal injury or property damage. It is up to you to decide whether you will need a lawyer, whether you can handle the ensuing real or possible problems on your own or whether your insurance company covers every aspect of you accident claim.

There are several different types of accident claims, including personal injury, property accident claims, and workplace UK accident claimsaccident claims. The most commonly cited accident claims, however, are the result of automobile crashes and collisions. The rules governing claims, in these instances, vary according to the severity of the accident, the ages of the participants and the causal factors as well as whether or not the people involved in the accident carry insurance. For instance, if your state statutes are comparative e.g. Nevada, you may make an accident claim and collect a settlement even if a police officer cites you for fro causal factors as long as you are not the primary cause of the accident. In several pure contributory states, even if you are the primary cause of the accident, you can still obtain a settlement.

Hurdles to overcome in automobile accident claims include a driver without insurance. If you are involved in an auto accident with an uncovered driver, you can, usually register a claim. The problem, however, is collecting a settlement. If you live in a no-fault state, there will be little problem. Nevertheless, to safeguard yourself, carry both insured and uninsured motorist coverage. This way, it becomes your insurance company’s headache.

Interestingly enough, in the United States , 2006 saw fewer accident claims reported to insurance companies. This has resulted in increased profit margins for AllstateCorp. and State Farm Insurance Cos. and other insurance companies. For Allstate, automobile claim filings have declined for the past four years at a greater rate than property damage claims. Speculation determined any number of possible reasons, including:

·         Safer automobiles - the result of improved and increased technology

·         Demographic trends – the boomer generation is now at the safest driving age. According to the National Council, in 2004, individuals between the ages of 45 and 64 represented 33 per cent of the drivers but comprised only 24 percent of accidents.

·         A decrease in the numbers of drunk drivers on the road – for over a decade, states have come down severely on drunken driving, reducing crashes.

·         Several states now have graduated licensing programs. These restrict very young drivers from driving until they get some practice on the roads. Some state regulations do not permit youths to drive at night; others only allow young adults to drive only if accompanied by an adult.

There is no clear indication whether the downward trend will continue. Even if there was, the best plan is to purchase sufficient insurance for yourself, your automobile and the rest of your possessions. Shop around for a reputable company before you decide to purchase. As the old maxim states: Better to be safe than sorry.
